Terms of Service

These Terms of Service (“Terms”) govern your use of the Wasim mobile application (the “App”) and the website wasim.chat (the “Site” — together, the “Service”), operated by Follow Your Instincts UG (haftungsbeschränkt), Birkenstr. 14, 67067 Ludwigshafen am Rhein, Germany (“we”, “us”, “our”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What Wasim is (and is not)

Wasim lets you import a chat transcript you exported from WhatsApp, choose a name and photo, and then continue that conversation with an artificial-intelligence agent that imitates the writing style found in the imported chat.

Wasim is an independent product. It is not affiliated with, endorsed by, or connected to WhatsApp LLC or Meta Platforms, Inc. “WhatsApp” is a trademark of its respective owner and is referenced only to describe compatibility with its chat-export format.

2. AI-generated content — important disclaimer

Replies in the App are produced by large language models operated by third-party providers (currently xAI's Grok models; we may use other models or providers at any time). AI-generated content is probabilistic and not fully controllable. You acknowledge and agree that:

• AI output may be inaccurate, incomplete, offensive, upsetting, inappropriate, or otherwise objectionable — especially where you steer the conversation in such a direction. We cannot and do not control or pre-review what the AI writes, and no output reflects our views.
• AI output does not come from, and does not represent the views, statements, or intentions of, the real person whose chat you imported. Any resemblance is a stylistic imitation you requested.
• AI output is not professional advice of any kind (medical, legal, financial, psychological, or otherwise) and must not be relied upon as such.
• You use the simulated conversations at your own risk. To the fullest extent permitted by applicable law, we accept no responsibility or liability for AI-generated content or for how you use or interpret it. Section 9 (Liability) applies.

If a conversation ever affects your wellbeing, please stop and reach out to people you trust or to professional support services. Wasim is not a substitute for human contact or professional help.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service you confirm that you meet this requirement.

4. Your content and responsibilities

• You may only import chats that you lawfully possess, and you are responsible for ensuring that importing and processing them does not violate the rights of others (including the other people in those chats) or any applicable law.
• You retain all rights to the content you import and the messages you write. You grant us the limited rights needed to operate the Service — i.e., to store, transmit, and process your content, including sharing relevant excerpts with our AI providers to generate replies, as described in our Privacy Policy.
• You must not use the Service to harass, defame, threaten, or harm any person; to generate or distribute unlawful content; to infringe third-party rights; or to attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
• Simulated conversations are for your personal use. Presenting AI output as genuine statements of the real person (e.g., publishing a simulated chat as if it were real) is prohibited.

5. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and Site for personal, non-commercial purposes. All intellectual-property rights in the Service remain with us or our licensors.

6. Availability and changes

The Service is provided free of charge and as available. We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also update these Terms; material changes will be announced in the App or on the Site, and your continued use after the effective date constitutes acceptance.

7. Termination

You can stop using the Service at any time and delete your data as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms or applicable law.

8. Third-party services

The Service relies on third-party providers (e.g., Google Firebase for hosting and infrastructure, xAI for AI models, Apple for distribution). Their availability is outside our control, and their own terms may apply to their products.

9. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body, or health, and under mandatory statutory liability provisions (e.g., the German Product Liability Act).

For slight negligence, we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), and in such cases only up to the damage that was foreseeable and typical at the time of contracting. Any further liability is excluded. This includes, to the extent legally permissible, liability for the content of AI-generated output as described in Section 2.

10. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer-protection provisions of your country of habitual residence remain unaffected.

The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
